Terms of Use

This page states the Terms and Conditions under which you may use CareerViet.vn of CareerViet Solotion Joint Stock Company (hereinafter referred to as the “Company”). Please read this page carefully.

By using this web site, you are indicating your acceptance to be bound by the terms of these Terms and Conditions. CareerViet may revise these Terms and Conditions at any time and it will be effective immediately by updating this posting. You should visit this page periodically to review the Terms and Conditions.

The terms You and User as used herein refer to all individuals and/or entities accessing this web site for any reason.

Frame agreement

  1. Employers will create their own account with username and password for using the services on careerviet.vn. Employers will be responsible for keeping their own username and password confidential and only use that account for their recruitment purpose. In case Employers lose or forget passwords, please contact CareerViet.vn immediately for assistance.
  2. After Employers have signed the Contract or Order and/or CareerViet has activated the services mentioned in the Contract or Order, Employer shall not be eligible to request service changes and Employer will be totally responsible for their own services usage.
  3. Employers shall be able to post their recruitment advertisement and/or mention about their website address on CareerViet.vn. Employers shall be fully responsible for the accuracy and legality of all the contents of their recruitment advertisements on CareerViet.vn or/and the recruitment-related content on the mentioned website.
  4. Employers shall use and exploit the information obtained in relation to the services under Contract/ Order with CareerViet for their recruitment purpose only. Employers shall not be allowed to disclose, share or sell the information gained about candidates to any third parties in any form in accordance with the applicable laws.
  5. The services purchased in the Contract/ Order are used by the Employer with Billing Information stated in the Contract/ Order (excluding related companies or subsidiaries). The job posting content must be consistent with industries registered in the Employer’s business license.
  6. In case of any breach of the provisions set forth in this article, CareerViet may remove any of Employer’s posting contents on CareerViet’s website and early terminate this Contract without refunding the fees that Employer have paid but not used. Also, depending on the seriousness of a violation, CareerViet may refer Employer’s violation to the relevant Authority and/or claim Employer for compensation for damages or losses arising from Employer’s breach.
  7. In case Employers have any signs of violation related to the above regulations, CareerViet has right to remove temporarily all contents and links posted and notify Employers. Subject to specific terms and conditions under the Contract/ Order, Employers should get refund for paid but unused service fee in case the CareerViet wants to terminate the contract unilaterally.
  8. By signing CareerViet’s Contracts / Orders / Agreements, Employer shall give CareerViet permission to use Employer’s Logo and Brand name for Marketing Campaigns in order to promote Employer’s vacancies to CareerViet’s potential candidates and users.
  9. The Use of Features provided in Talent Solution package or offered in CareerViet''s All Job Trial programs are not required and will base on client''s demand.
  10. Each position/job title will be posted one time only and should be reposted after 30 days when the old job is expired. In case the Employer wants to post a new job, the current active job with the same content must be inactivated. CareerViet will check and inactive the job duplications without notification to the Employer.
  11. All the information posted by the Employers on CareerViet.vn and its partner sites shall not mention or defame competitors. CareerViet reserves the right to refuse to post or remove any content that is related to this rule.

Job posting regulation

A - About Job Title/Job Description/Job Requirement:

  1. Cannot be changed once the job is posted on CareerViet.vn
  2. Only 01 (one) job title, its corresponding job description and requirement can be used for each job posting
  3. The first letter of each word must be in capitalized (for example: Sales Manager, Trưởng Phòng Kinh Doanh…). All letters of an abbreviation must be in capital (for example: ĐHKK, ERP, CAD, .NET, PCCC…)
  4. Try not to use both English and Vietnamese for a job title (Kế toán quản trị - Management Accountant, Nhân viên thu mua – Purchasing Staff…)
  5. Do not mix English with Vietnamese in a job title as candidates may find it difficult to search for your job (for example: Nhân viên Technical máy tính) except for the following cases:
    • No Vietnamese phrases to exactly describe the job (Nhân viên ERP, chuyên viên ISO, Lập trình viên .NET…)
    • Common English Phrases (Nhân viên QC, Kỹ sư M&E…)
  6. Words and phrases such as “Tuyển”, “làm việc tại”, “phòng…”; information such as no. of hires, work location, products, targeted candidates, departments, salary, languages, gender… must be shown in the job description or suitable provided fields and removed from the job title.


B - Job content:

  1. Must provide detailed and specific information of your job: description, requirements, benefits and other useful information.
  2. Requirements must be given in separate sentences. Try not to write your requirements in a paragraph. Remove the phrases such as: “Job details will be discussed upon interview”; “information will be given in interview”…; URLs and links.
  3. Do not share your contact information such as phone, email in the job content.

C - Products, goods and services banned from advertising

  1. Goods banned from trading and services banned from provision by law;
  2. Cigarettes;
  3. Liquors of an alcoholic content of 150 or higher;
  4. Breastmilk substitutes for children under 24 months, dietary supplements for children under 6 months, feeding bottles and pacifiers;   
  5. Prescription medicines; non-prescription medicines which are recommended by competent state agencies for restricted use or use under physician supervision;
  6. Goods and products of obscene nature;
  7. Hunting rifles and bullets, sports weapons and violence-inciting products and goods; and
  8. Other products, goods and services banned from advertising to be specified by the Government to meet practical requirements.

D - WOW-Service program:

  1. All clients are eligible for WOW-Service program for their ineffective job postings.
  2. Any ineffective job postings will be supported automatically with REFRESH JOB after 7,14 and 30 days of posting and BOLD&RED as a special offer after 14 days of posting.
  3. Ineffective job posting is defined as any job receiving fewer than 30 application after 30 days of posting. Any ineffective job postings will be reposted maximum 2 times without any extra cost. Support to repost ineffective jobs with full additional services of the paid job.
  4. Matched resume: offer FREE 5 resumes from tag for each job posting.
  5. Ineffective job postings of clients with ranking from Gold and up, aside from being reposted, will be included in special WOW-Service program with special commitment of faster support time and full additional service inclusion of the corresponding ineffective job for each repost time.
  6. Clients with raking from Gold and up will have separate Hot Mail for each ranking to ensure that each customer is supported promptly in accordance with CareerViet’s time commitment.

PERSONAL DATA PROTECTION

  1. CareerViet and Employers shall comply at all times with the applicable laws regarding personal data protection.
  2. Employer shall use the personal data obtained through services provided by CareerViet (hereinafter referred to as "Personal Data," as defined in Decree No. 13/2023/ND-CP on the Protection of Personal Data) in accordance with the terms and conditions of the contract/ purchase order, the terms of use and privacy policy of CareerViet, as updated from time to time.
  3. Employer shall only use the Personal Data within the scope of the purpose of the contract/ purchase order and shall not provide, disclose, leak, or use it for any other purposes to third parties.
  4. Employer shall take necessary measures to maintain confidentiality, such as entering into confidentiality agreements with its employees or its clients, or subcontractors engaged, and shall also take the measures necessary for the management of Personal Data.
  5. CareerViet may request measures that it deems necessary for the appropriate handling of Personal Data in addition to those specified in the preceding items, and Employer shall sincerely comply with such requests.
  6. CareerViet may request the submission of documents or other necessary materials containing the measures taken for the management of Personal Data to verify the status of compliance with the measures necessary for the management of Personal Data.
  7. If Employer subcontracts part of the recruitment to other contractors or provides recruitment services to other entities, Employer must impose on such entities the same confidentiality obligations as stipulated in this article.
  8. If Employer needs to duplicate, reproduce, or modify Personal Data obtained beyond the scope of the purpose of the recruitment, Employer must obtain the prior consent of CareerViet or the data subjects (hereinafter referred to as "Data Subjects," as defined in Article 2.6 of Decree No. 13/2023/ND-CP on the Protection of Personal Data).
  9. After the termination of the contract/ purchase order, Employer shall ensure the confidentiality of all Personal Data acquired or created during the contract/ purchase order term and shall return it to CareerViet, erase, destroy it, or take other appropriate measures in accordance with CareerViet''s instructions (if applicable).
  10. Employer, when collecting Personal Data on its own for the purpose of recruitment, must handle it in a lawful and appropriate manner within the necessary scope to achieve the purpose.
  11. If Employer violates any of the provisions stipulated in this article without legitimate reasons, CareerViet may terminate the contract/ purchase order. In this case, CareerViet may also claim damages from Employer. In case where Employer and/or its subsidiary is in breach of the data protection provision, Employer shall assume any and all liabilities, and obligations; pay all reasonable compensation for losses, damages caused to CareerViet and/or any third parties and keep CareerViet free and harmless from any request, claim, legal action taken by any third CareerViets the result of such breach by the Employer / its subsidiary.
  12. If Employer acknowledges the existence of facts indicating criminal acts regarding the handling of personal data in the course of the entrusted business by those engaged in or who have been engaged in the entrusted business, Employer shall promptly report such facts (and in any event within 24 hours) to CareerViet. Such notice shall have the following contents:
    • describe the nature of the breach, including time, location, acts, organizations, individuals, the categories and number of data concerned;
    • contact details of employees assigned with data protection or organizations or individuals responsible for personal data protection;
    • describe the likely consequences and damages of the breach of personal data protection regulation;
    • and describe the proposed measures to address and mitigate effects of the breach of personal data protection regulation.
  13. This obligation shall also apply after the termination of the contract/ purchase order.

Use of Web Site Content

The Company authorizes you to view and access a single copy of the content available on or from CareerViet.vn (the Web Site) solely for your personal, noncommercial use.

The contents of this Web Site, and of all other websites under the Company''s control, whether partial or otherwise (the Website and such other websites are sometimes collectively referred to as CareerViet Sites) such as text, graphics, images, logos, button icons, software and other Web Site content (collectively, "Web Site Content" are protected under both Vietnam and foreign copyright, trademark and other laws. All Web Site Content is the property of the Company or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on this Web Site is the exclusive property of the Company and protected by Vietnam and international copyright laws. Unauthorized use of the Web Site Content may violate copyright, trademark, and other laws. You must retain all copyright, trademark, service-mark and other proprietary notices contained in the original Web Site Content on any copy You make of the Web Site Content. You may not sell or modify the Web Site Content or reproduce, display, publicly perform, distribute, or otherwise use the Web Site Content in any way for any public or commercial purpose. The use of the Web Site Content on any other web site or in a networked computer environment for any purpose is prohibited.

You shall not copy or adapt the HTML code that the Company creates to generate any Web Site Content or the pages making up any CareerViet Site. It is also protected by the Company''s copyright.

Acceptable Site Use

General Rules: Users may not use any CareerViet Site in order to transmit, distribute, store or destroy material, including without limitation Web Site Content, (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful.

CareerViet Site Security Rules

Users are prohibited from violating or attempting to violate the security of any CareerViet Site, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to any CareerViet Site, overloading, flooding, spamming, mailbombing or crashing, or (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

Specific Prohibited Uses

CareerViet Sites may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. The Company specifically prohibits any use of the Web Site, and all users agree not to use the Web Site, for any of the following:

  1. Posting any incomplete, false or inaccurate biographical information or information which is not your own accurate resume (living individual seeking employment on a full-time or part-time basis on his or her own behalf).
  2. Posting any franchise, pyramid scheme, club membership, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (except for postings that make clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), requires recruitment of other members, sub-distributors or sub-agents.
  3. Operating in unrecognized business types such as virtual currency, and crypto.
  4. Using the CareerViet Resume Database for any purpose other than as an employer seeking employees, including but not limited to using the information in the Resume Database to sell or promote any products or services.
  5. Sending unsolicited mail or e-mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a user of a CareerViet Site.
  6. Deleting or revising any material posted by any other person or entity.
  7. Using any device, software or routine to interfere or attempt to interfere with the proper working of any CareerViet Site or any activity being conducted on this site.
  8. Taking any action which imposes an unreasonable or disproportionately large load on any CareerViet Site''s infrastructure.
  9. If You have a password allowing access to a non-public area of this Web Site, disclosing to or sharing your password with any third parties or using your password for any unauthorized purpose.
  10. Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search any CareerViet Site other than the search engine and search agents available from the Company on such CareerViet Site and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer).
  11. Other prohibited activities stipulated by the law.
     

User Information

When You register for the Web Site, You voluntarily provide the Company with certain information required for the registration application process including, without limitation, a valid email address (Your Personal Information). In addition to the terms and conditions that may be set forth in any privacy policy on this Web Site, You understand and agree that the Company may process and disclose to third parties, on an anonymous basis, certain aggregate information including Your Personal Information contained in your registration application that has been voluntarily provided by You to the Company. The Company will not disclose to any third party your name, address, e-mail address or telephone number or any other personal information of yours without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant. The Company reserves the right to offer third party services and products to You based on the preferences that You identify in your registration and at any time thereafter; such offers may be made by the Company or by third parties. Please see the Company''s Privacy Policy for further details regarding Your Personal Information.

Each candidate made available through the skilled and hourly section of the CareerViet Web Site has taken skills interview(s) offered by the Company. The results of each skilled and hourly candidate''s skills interview are not evaluated by Company and should be evaluated by each employer based on such employer''s specific criteria. The skills interview(s) are proprietary to Company and may be changed from time to time in Company''s discretion. The skills interviews do not necessarily guarantee performance results or capture all criteria that may be relevant to an employer in making employment decisions. Company does not independently verify the information provided by candidates or the identity of candidates.

As a user, You are responsible for your own communications and are responsible for the consequences of your posting. You must not, and by using any CareerViet Site You agree not to, do the following things:

  1. Post material that is copyrighted, unless You are the copyright owner or have the permission of the copyright owner to post it, post material that reveals trade secrets, unless You own them or have the permission of the owner;
  2. Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others;
  3. Post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity;
  4. Post material that is off-topic on topic-specific message boards;
  5. Post a sexually explicit image or statement;
  6. Post advertisements or solicitations of business, post chain letters or pyramid schemes;
  7. Impersonate another person; 
  8. Post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; and
  9. Any prohibited activities stipulated by the law.

The Company does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.

The Company acts as a passive conduit for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to these Terms and Conditions, the Company may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. The Company has no liability or responsibility to users for performance or nonperformance of such activities. The Company reserves the right to expel users and prevent their further access to the Web Site for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive. The Company may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers. By submitting content to any public or non-public area of any CareerViet Site, including message boards, forums, contests, surveys and chat/interview rooms, You grant the Company and its affiliates the loyalty-free, perpetual, irrevocable, sublicensable (through multiple tiers), non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content. You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to You the right to grant the license stated above. You also permit any subscriber to access, display, view, store and reproduce such content for personal use. Any hyperlinks, hidden keywords or any keywords that are irrelevant to the job or are otherwise misleading contained in a job posting are prohibited.

Please be advised, however, that our policy does not permit us to accept or consider creative ideas, suggestions, inventions or materials other than those which we have specifically requested. While we do value your feedback on our services, please be specific in your comments regarding our services and do not submit creative ideas, inventions, suggestions, or materials. If, despite our request, You send us creative suggestions, ideas, drawings, concepts, inventions, or other information (collectively the Submission), the Submission shall be the property of the Company. None of the Submission shall be subject to any obligation of confidence on our part and we shall not be liable for any use or disclosure of any Submission. The Company shall own exclusively all now-known or later discovered rights to the Submission and shall be entitled to unrestricted use of the Submission for any purpose whatsoever, commercial or otherwise, without compensation to You or any other person who submitted the Submission.

Registration and Password

You are responsible for maintaining the confidentiality of your information including Your Personal Information and your password. Identification Of Agent To Receive Notification And Elements Of Notification Of Claimed Copyright Infringement

CareerViet.vn, and all of our affiliated companies respect the intellectual property of others, and we ask our users, account holders and content partners to do the same. The unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to your use of this Web Site, You agree not to use the Web Site or any other CareerViet Site to infringe the intellectual property rights of others in any way. We will terminate the accounts of any account holders, and block access to our Web Site and/or the other CareerViet Sites of any users, who are repeat infringers of the copyrights, or other intellectual property rights, of others. We reserve the right to take these actions at any time, in our sole discretion, with or without notice, and without any liability to the account holder who is terminated or to the user whose access is blocked.

CareerViet is not responsible for those who use other people’s emails/phones for bad purposes, such as: spamming or distributing bad content, etc. that may affect the true owners of those emails/phones. The users themselves are responsible in front of civil court for any bad acts or law-violated content. CareerViet retains the rights to remove and block accounts that violated the terms of use without advance notice.

The Company''s Liability

  1. CareerViet.vn is only a venue. This Web Site acts as a venue for employers to post job opportunities and candidates to post resumes and does not screen or censor the listings offered. The Company is not involved in the actual transaction between employers and candidates. As a result, the Company has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through the Web Site and/or the other CareerViet Sites.
  2. Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on any CareerViet Site, in the event that You have a dispute with one or more users, You release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
  3. We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Web Site and/or the other CareerViet Sites. By its very nature, other people''s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled

The Company makes no representations about the accuracy, reliability, completeness, or timeliness of any CareerViet Site or the Web Site Content. The use of CareerViet Sites and the Web Site Content is at your own risk. Changes are periodically made to CareerViet Sites and may be made at any time.
  6. You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on the CareerViet Sites. Employers are solely responsible for their postings on CareerViet Sites.
  7. The Company is not to be considered to be an employer with respect to your use of any CareerViet Site and the Company shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on any CareerViet Site.
  8. The Company does not warrant that any CareerViet site will operate error-free or that any CareerViet site and its server are free of computer viruses or other harmful mechanisms. If your use of any CareerViet site or the web site content results in the need for servicing or replacing equipment or data, the company is not responsible for those costs.

Disclaimer of Consequential Damages

In no event shall the company, its suppliers, or any third parties mentioned on any CareerViet site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use any CareerViet site and the web site content, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.

By posting jobs CareerViet.vn, you understand that your job description, your company and other essential information may be used on our partner sites without informing you in advance including but not limit: Vieclam.Vietnamnet.vn; Vieclam.Tuoitre.vn; VieclamIT.vn, in order to increase the posting effect. In case you do not want to display your information on our partner sites, please do not hesitate to contact our Sales Reps for a timely support.

The Web Site and certain other CareerViet Sites contain links to third party web sites. These links are provided solely as a convenience to You and not as an endorsement by the Company of the contents on such third-party Web sites. The Company is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If You decide to access linked third party Web sites, You do so at your own risk.

No Resale or Unauthorized Commercial Use.

You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of any CareerViet Site.

Complaint and Dispute Resolution Procedure/ Responsibility

When a dispute arises between a member / candidate / employee (collectively referred to as a third party) and a company that uses CareerViet''s services, CareerViet Solution Joint Stock Company highly values the negotiation and mediation solution among The parties to maintain the reliability of the third party in the service quality of CareerViet. We will take steps to resolve disputes and complaints as follows:

Step 1: CareerViet receives feedback from third parties that companies using CareerViet services have inappropriate job posting content, companies that use services to improperly approach and contact candidates such as resume database, email marketing, etc., or companies collect money from a third party but fail to provide the commitments between the parties or claims associated with the related liability of the companies using CareerViet services.

Step 2: Customer Services Department or Sales Department of CareerViet Solution Joint Stock Company receives feedback from third parties. These departments actively seek further details from the third party and respond to the results of resolving complaints based on the policies that the Company has announced. We reserve the right to suspend job postings, or related services immediately, without consent from companies using CareerViet''s services and notify the relevant information to these companies within 8 working hours.

Step 3: In the event that companies using CareerViet services do not provide credentials or these companies and third parties cannot reach a common agreement through negotiation, CareerViet reserves the right to suspend the job posting or stop providing services until these companies settle their disputes with third parties.

CareerViet Solution Joint Stock Company is exempt from liability for disputes between companies using the services of CareerViet and third parties for any arising complain and dispute.

Termination
